The High Court has now thrown out the Banks appeal that 'a regulator may investigate the fairness of over charges'. Although the Banks will show no shame in challenging the latest decision, by asking the House of Lords for permission to challenge the appeal further, the office of Fair trading (OFT) has welcomed the Appeal Court ruling.

What has Actually happened?

The Eight Banks were arguing that their excessive overdraft charges fell outside the scope of the 1999 unfair Terms in contracts Regulations.

However all three Appeal court Judges have now “unanimously concluded that the application should be refused” (Sir Anthony Clarke)

This great news for everyone who continues to patiently for news on their bank charge claim.

Although it is likely to run into late 2009 possibly even 2010 the Banks are running out of courts and red tape to hide behind.
